Consumer understanding

Building on FBC’s existing programme of work regarding fund boards’ oversight of disclosure requirements, this research and discussion examines how AFMs are testing customer understanding of fund disclosures and marketing literature.

FBC’s latest research explores how authorised fund manager (AFM) boards are meeting their Consumer Duty obligations, especially around the Consumer Understanding outcome.

This remains highly topical, especially in light of the FCA’s ongoing Consumer Composite Investments (CCI) consultation, seeking to simplify and enhance disclosure for investment products.

Our research explores critical questions including:

  • What types of customer documents are being tested for clarity and comprehension?
  • Who is involved in testing?
  • How are firms conducting consumer understanding tests?
  • Who oversees the results, and to what extent is the fund board involved?
  • Are distributor-created factsheets being tested for clarity and alignment?
  • What actions have been taken in response to testing findings?

This will be followed by a panel discussion with:

  • Angie Keogh, Head of Risk and Compliance, Omnis Investments
  • Katharyn Howchen, Head of EMEA Financial Promotions Marketing Governance, BNY Investments

Contributors

Brendan leads on product governance matters at Royal London Asset Management. He has more than 25 years of experience in the investment management industry, focused on risk management and fund governance disciplines.

Katharyn is Head of EMEA Financial Promotions Marketing Governance at BNY Investments. With over 15 years of experience in investment marketing, she specialises in regulatory implementation, financial promotions compliance and governance across EMEA distribution markets. Katharyn sits on a number of the firm’s key product and distribution governance committees, including its Consumer Council which is dedicated to matters relating to the implementation and ongoing adherence to the FCA’s Consumer Duty. 

Angie oversees risk management and regulatory compliance at Omnis Investments. She has over 20 years of experience in financial services working in investment management, life assurance and insurance sectors with knowledge of various products from the manufacturing stage to distribution. She specialises in governance, investment oversight and regulatory frameworks.

Simon joined the Fund Boards Council as a Senior Adviser in January 2022 to work on Distributor oversight and Fund governance initiatives. He is a portfolio INED and has extensive UK & European Asset Management distribution leadership experience from a financial services career spanning 34 years. UK AFM board experience with expertise in Assessment of Value and Consumer Duty. Non-exec chair of national law firm’s wealth management business. Irish fund board iNED for UK-based impact ETF range. Independent non exec director for bank-owned UK and international asset management businesses . In depth knowledge of UK & European retail funds (UK & UCITS) plus listed investments (ETFs & Investment Companies) and the associated distribution landscape (Wealth Management platforms, Fintech etc).
